482 partner and child visas: planning a subsequent entrant application

Family planning should begin before the primary 482 application is submitted. If a partner or child was not included, the correct next step may be a subsequent entrant application rather than an attempt to add them to the lodged primary application.

KEY TAKEAWAYS

  • Primary application status and grant records obtained
  • Relationship and family-unit evidence assessed
  • Parenting orders or consent issues identified
Start with the complete picture. Read the Including your partner and children alongside our Skills in Demand visa overview.

Check the application stage first

Home Affairs states that family members cannot be added to a primary 482 application after it has been submitted. The subsequent entrant pathway can be relevant while the primary application is undecided or after the primary visa has been granted.

Check the family member’s eligibility and the applicable sponsor requirements. A marriage or birth certificate is a starting point, not a complete assessment of every family circumstance. Existing visa status also matters for someone applying in Australia.

Prepare evidence for the actual family relationship

For a partner, organise evidence of the relationship as applicable to the case, including its history and present circumstances. Explain periods apart, name differences and previous relationships accurately. For children, address the relevant dependency and family-unit requirements.

Where another parent has parental responsibility, obtain advice about consent and the documents needed. A family visa does not resolve every parenting or international relocation issue. Keep court orders and existing arrangements available for review.

Budget and plan the move together

Consider separate application charges, health and character requirements, insurance and practical settlement costs. The primary worker’s visa position and remaining stay should be considered before committing to travel, schooling or a lease.

A hypothetical worker who moved first and wants their family to follow should collect the primary application and grant records as well as family evidence. Emigrate Lawyers can assess the appropriate application sequence and identify whether family or parenting issues need separate advice.

Common questions

Can I simply add my partner after lodging?

Home Affairs directs family members not included in a submitted primary application to consider the subsequent entrant pathway.

Is a dependant’s stay automatically permanent?

No. This is a temporary visa pathway linked to the relevant 457 or 482 circumstances.
