Managing sponsorship obligations

Sponsorship compliance continues after approval. Employers need a practical system for employment records, changes, payments and communication with the Department.

KEY POINTS

  • Assign an internal owner for sponsorship records and reporting.
  • Review changes in employment or business structure promptly.
  • Check cost recovery and payroll arrangements against sponsor obligations.

Assign ownership

Choose an internal contact responsible for the sponsored-worker register and ensure HR, payroll and operational managers know when to involve them. Keep copies of approvals, contracts, position descriptions and relevant correspondence in a controlled location. Access should reflect the sensitivity of personal information rather than being available to every manager.

Make changes visible

Changes to employment, hours, duties, pay, business structure or ownership may need notification or further assessment. Build a review point into promotions, transfers, leave arrangements and termination processes. The applicable notification requirements should be checked when an event occurs; they should not be left until the next visa application. Keep evidence of what was reported and when.

Check costs and records

Sponsorship obligations include requirements concerning records, information, employment conditions and certain costs. Review proposed deductions or repayment clauses before using them with a sponsored worker. An agreement signed by the worker does not necessarily make cost recovery lawful. Prepare for an information request by keeping records current, rather than reconstructing the employment history later. A brief internal checklist can help managers recognise these events and direct them to the responsible contact.

Hypothetical example

A sponsored employee is promoted and moved to another branch. The manager informs HR before the change takes effect so that the occupation, duties and sponsor position can be reviewed. That simple internal trigger helps identify whether notification or a different nomination arrangement is needed.
