KEY POINTS
- The current agreement determines which positions and workers it can support.
- Concessions apply only where the particular agreement permits them.
- Agreement access does not itself grant a nomination or visa.
Read the agreement, not a general summary
An agreement may specify occupations, nomination limits and worker requirements. Any concessions depend on the agreement and its conditions; they are not available to all employers in an industry. Begin with the current signed agreement and any variations. Confirm the employing entity, the relevant location and whether the proposed role falls within its scope.
Separate agreement access from visa eligibility
Having an agreement does not itself give an employee a visa. The employer must still complete the applicable nomination process and the worker must satisfy the requirements for their application. A recruitment conversation about possible agreement access is different from an approved arrangement that can support a nomination. Ask what has actually been approved and what remains to be done.
Prepare the facts that matter
For the employer, assemble a workforce summary, recruitment history and a clear explanation of the proposed position. For the worker, prepare qualifications, employment evidence and English information. Identify any concession the parties intend to rely on and the evidence supporting it. If permanent residence is part of the discussion, check that separately against the agreement and future visa criteria; it should not be presented as an automatic outcome.
Hypothetical example
A regional employer has heard that a nearby business uses a labour agreement. That does not establish access for its own vacancy. The employer first checks the relevant arrangement, its geographic scope and the approval steps required for its business.
