KEY POINTS
- Match the occupation to real duties rather than the job title.
- Apply the correct occupation test for the proposed stream.
- Assess the worker’s background separately from the position’s eligibility.
Start with duties, not the title
Prepare a plain description of the tasks, responsibilities, reporting level and skills required. Compare that work with the relevant occupation classification. Employers often use internal titles that differ from migration classifications, so an exact title match is neither necessary nor sufficient. The nominated occupation should describe the genuine position, not the pathway the parties would prefer.
Apply the stream-specific test
Core Skills uses the Core Skills Occupation List. Specialist Skills has its own occupation restrictions and salary settings. Labour Agreement eligibility depends on the agreement. Do not use a list prepared for another visa as proof that the role qualifies for 482 sponsorship. Check any caveats and current instruments linked from the official guidance.
Check the person separately
Even where the position fits an eligible occupation, the applicant must demonstrate the required background and satisfy the other visa criteria. Registration, licensing or formal assessment may require separate work. Gather qualifications and detailed references, then compare the person’s experience with the proposed duties. If the match is uncertain, resolve it before the employer builds the nomination around that occupation.
Hypothetical example
A business calls a role ‘operations manager’, but most of its work is administrative support. The employer documents the real responsibilities and assesses the appropriate occupation. Choosing a more senior title solely because it appears on a list would not establish eligibility.
