KEY TAKEAWAYS
- Proposed permanent stream identified
- Age and relevant application date checked
- Exact exemption tested with evidence
Ask the temporary and permanent questions separately
The standard 482 pathway does not apply the same general age rule as the usual 186 pathway. A person may therefore be able to work temporarily while facing a separate age issue for permanent residence.
Identify the permanent stream proposed and the relevant age criterion. Do not assume that remaining with an employer for a particular period removes the age requirement. The employer’s willingness to nominate cannot create an exemption that the law does not provide.
Test any exemption against the actual rules
Some circumstances may support an age exemption, but the requirements are specific and can involve the occupation, employment, earnings or an applicable agreement. Avoid relying on an online statement that a high salary always creates an exemption.
Collect the records needed to assess the precise category being considered. A current salary offer may not establish a requirement involving historical earnings or employment. An agreement concession should be checked against the actual agreement and occupation.
Plan around dates with realistic alternatives
Record the worker’s birthday, visa expiry, employment history and likely evidence preparation period. Consider whether a pathway can be supported on the known facts and which parts remain uncertain. Do not let a projected PR date become a guarantee in an employment discussion.
An illustrative worker aged 44 may need a different planning conversation from someone already 47. Emigrate Lawyers can assess the permanent stream and any credible exemption before the parties make major relocation commitments. Where the evidence does not support the proposed pathway, that limitation should be understood early.

Common questions
Can an employer waive the 186 age rule?
No. Any exemption or concession must arise under the applicable legal framework.
Should I wait until my 482 is expiring to ask about age?
Early assessment gives more time to understand any viable pathway and its limits.
